Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: The period during which the consumer can exercise the right of withdrawal.
Consumer: A natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.
Day: Calendar day.
Ongoing transaction: A distance contract relating to a series of products and/or services, where delivery and/or purchase obligations are spread over time.
Durable data carrier: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person offering products and/or services to consumers at a distance.
Distance contract: An agreement concluded within a system organized by the entrepreneur for distance selling, using one or more means of distance communication.
Means of distance communication: Any method used to conclude an agreement without the consumer and entrepreneur being physically present together.
Terms and Conditions: These present Terms and Conditions of the entrepreneur.
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the agreement within a cooling-off period of 30 days without giving any reason. During this period, the consumer must handle the product and packaging with care.
If the right of withdrawal is exercised, the product must be returned with all accessories and, if reasonably possible, in its original condition, following the entrepreneur’s instructions.
Article 3 – Applicability
These terms apply to every offer made by the entrepreneur and to all distance contracts and orders between the entrepreneur and the consumer.
Before concluding a distance contract, these terms will be made available to the consumer. If this is not reasonably possible, it will be indicated where the terms can be reviewed and that they will be sent free of charge upon request.
If the agreement is concluded electronically, the terms may be provided digitally in a way that allows easy storage on a durable data carrier.
If additional product or service conditions apply, the consumer may always rely on the provision most favorable to them in case of conflicting terms.
If any provision is deemed invalid, the remaining provisions will remain in force and the invalid part will be replaced with a provision that closely reflects the original intent.
Situations not covered by these terms should be interpreted in the spirit of these terms.
Article 4 – The Offer
If an offer has a limited validity or conditions, this will be clearly stated.
The offer is non-binding, and the entrepreneur may modify it.
All product descriptions are complete and accurate to allow proper evaluation.
Images are a true representation, but minor errors or inaccuracies do not bind the entrepreneur.
All images and specifications are indicative and cannot lead to compensation or contract termination.
Colors displayed may differ from actual product colors.
Each offer clearly outlines the consumer’s rights and obligations, including:
- Shipping costs (if applicable)
- How the agreement is concluded
- Whether the right of withdrawal applies
- Payment, delivery, and execution methods
- Offer validity period
- Communication costs (if applicable)
- Whether the contract is archived
- How data can be checked and corrected
- Available languages
- Applicable codes of conduct
- Minimum duration (if applicable)
- Optional: sizes, colors, materials
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the conditions.
Electronic acceptance is confirmed immediately. Until confirmation, the consumer may cancel the agreement.
The entrepreneur ensures secure data transfer and payment processing.
The entrepreneur may assess the consumer’s ability to meet payment obligations and may refuse or set conditions on orders if necessary.
The following information will be provided to the consumer:
- Business contact address
- Withdrawal conditions
- Warranty and service details
- Relevant offer information
- Termination conditions for long-term contracts
All agreements are subject to product availability.
Article 6 – Right of Withdrawal (Detailed)
Consumers may withdraw from a purchase within 30 days after receiving the product.
The product must only be used to assess its suitability.
Returns must include all accessories and, if possible, original packaging.
The consumer must notify the entrepreneur within 30 days and return the product within 30 days thereafter.
Proof of return shipment may be required.
If these conditions are not met, the purchase is final.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be issued within 30 days after withdrawal, provided the product has been received or proof of return is provided.
Article 8 – Exclusion of Right of Withdrawal
The right of withdrawal may be excluded for products that:
- Are custom-made
- Are clearly personal
- Cannot be returned
- Spoil quickly
- Have price fluctuations outside the entrepreneur’s control
- Include newspapers or magazines
- Include opened software or media
- Include opened hygiene products
Article 9 – Pricing
Prices will not increase during the validity period unless due to VAT changes.
Variable pricing may apply for market-dependent products.
Price increases within 3 months are only allowed due to legal changes.
After 3 months, increases are only allowed if agreed and the consumer may terminate the contract.
All prices are subject to typographical errors.
Article 10 – Conformity and Warranty
Products comply with the agreement, specifications, and legal requirements.
Warranty does not affect statutory consumer rights.
Defects must be reported within 30 days.
Warranty does not apply in cases of misuse, improper handling, or unauthorized modifications.
Article 11 – Delivery and Execution
Orders are processed with care and delivered within 30 days unless otherwise agreed.
Delays or partial deliveries will be communicated within 30 days.
Consumers may cancel in such cases and receive a refund.
Replacement products may be offered if necessary.
Risk transfers to the consumer upon delivery.
Article 12 – Duration Transactions
Consumers may cancel ongoing contracts at any time with up to one month’s notice.
Fixed-term contracts can be terminated at the end of the term.
Automatic renewal is restricted and subject to specific conditions.
Contracts longer than one year can be canceled after one year with one month’s notice.
Article 13 – Payment
Payments must be made within 7 working days unless agreed otherwise.
Consumers must report payment errors immediately.
In case of non-payment, reasonable costs may be charged.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after discovering an issue.
They will be answered within 14 days.
If more time is needed, an acknowledgment will be sent.
Unresolved complaints may lead to a dispute.
Valid complaints will result in repair or replacement.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
